Once someone has been arrested and arrives at the jail, then what? This article will explain the steps and procedure an arrestee will go through upon arrival to the jail and the booking process that follows while awaiting bond or arranging for a bondsman.
Unfortunately, there is nothing quick or speedy about being processed into a jail facility and sometimes it can take up to 12 hours to be processed. In most cases, you will not be able to arrange bail or hire a bail bondsman until this is completed. However, you should contact a bail bonds company as soon as possible to get the bail process started. A good bondsman will be able to guide you at the jails they service.
The booking process is as follows:
Personal information
The defendant will be asked to supply the following information: name, address, phone number, social security, phone number, and next of kin information. It's important to give true, accurate information.
Photograph
This is probably the worse picture anyone will ever take. Most often, people will not be smiling, due to the circumstances, but it is something you have to endure. This it that "mug shot" you thought you would never have.
Collection of personal property
Jailers will take everything that the defendant has on their person away, all personal items. They collect purses, wallets, jewelry, cash and cellar phones and will then itemize it all, and provide a receipt. Once the individual is released from custody, these items are returned, unless there is something illegal or something that will be kept for evidence.
Identification and Fingerprinting
All arrestees will be fingerprinted and personal information is entered into the national crime database. Police will check information with this database for any outstanding warrants. This is generally the longest part of the booking process and regularly takes four hours, but can take two or three times that depending on how busy law enforcement is throughout the country.
Body search
This is probably the most humiliating, uncomfortable and embarrassing situation anyone has ever been in. There is nothing fun about this part of it at all, but knowing what to expect may help. Arrestees could either undergo just a pat down or a full cavity search. Men and women are searched only by the corresponding personnel: meaning - women are searched by women and men are searched by men.
Next Steps
Once the above process has been completed, defendants are then taken to a jail cell where they will remain until the bail bondsman has made arrangements for release. It is sometimes possible to be released on one's Own Recognizance ("OR"), if you have a minor offense or the defendant could wait in jail to appear before a judge, which generally takes three business days.
Finally, a Phone Call
At some point in the process the defendant will be able to make a phone call. The following are some important details to supply during that phone call:
1. Full name and date of birth. Do not give a nickname, it is very important to give the full legal name - the same name on identification and that was provided to the arresting officers.
